Her family planned to attend an annual, three-day religious convention of Jehovah\u00e2\u20ac\u2122s Witnesses in Mainz. The school authorities denied the family\u00e2\u20ac\u2122s request for Vivienne to be excused from school for the Friday session of the convention. Nevertheless, concern for Vivienne\u00e2\u20ac\u2122s spiritual education prompted her parents to take her to the convention despite the denial. Vivienne\u00e2\u20ac\u2122s parents appealed to the State Board of Education (Board) concerning the denial by the school authorities. Instead of recognizing the convention as a religious holiday, the Board ordered them to pay an administrative fee.<\/p>\n<figure style=\"width: 500px\" class=\"wp-caption aligncenter\"><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/i.imgur.com\/iqZwOZL.jpg\" alt=\"\" width=\"500\" height=\"250\" border=\"0\" \/><figcaption class=\"wp-caption-text\">The Falcone family attending a convention of Jehovah\u00e2\u20ac\u2122s Witnesses\u00c2<\/figcaption><\/figure>\n<p id=\"p3\" class=\"p3 disableActiveState jsHasHighlightListener\" style=\"text-align: justify; margin: 1.25em 0px; padding: 0px; border: 0px; text-size-adjust: none; -webkit-tap-highlight-color: transparent;\">The Board\u00e2\u20ac\u2122s denial had potential negative consequences for Vivienne\u00e2\u20ac\u2122s parents because under German law, an unexcused absence from school is considered a violation of the parents\u00e2\u20ac\u2122 legal obligation to send their children to school. The offense can be punished with a fine and even imprisonment in extreme cases. From a broader perspective, Vivienne\u00e2\u20ac\u2122s parents considered the denial to be an infringement on their religious freedom and their right to raise their child according to their religious beliefs.<\/p>\n<\/div>\n<\/div>\n<div id=\"section2\" class=\"section\" style=\"margin: 0px; padding: 0px; border: 0px; text-size-adjust: none; font-family: 'Helvetica Light', Helvetica, 'Droid Sans', Arial, 'Arial Unicode MS', sans-serif; font-size: 14px;\">\n<h2 id=\"p4\" class=\"p4 disableActiveState jsHasHighlightListener\" style=\"text-align: justify; margin: 1em 0px 0.5em; padding: 0px; border: 0px; text-size-adjust: none; color: #65605e; line-height: 1.2; font-size: 22.4px; -webkit-tap-highlight-color: transparent;\">Right to Religious Holidays on Trial<\/h2>\n<div class=\"pGroup\" style=\"margin: 0px; padding: 0px; border: 0px; text-size-adjust: none;\">\n<div style=\"text-align: justify;\">Vivienne\u00e2\u20ac\u2122s parents, Stefano and Elisa, filed a complaint in an administrative court to contest the actions of the Board. They argued that the daylong religious services provide an opportunity to worship God as a family and to build faith. They stated: \u00e2\u20ac\u0153The conventions are an annual highlight and a special occasion in our religious practice.\u00e2\u20ac\u009d<\/div>\n<div style=\"text-align: justify; margin: 0px; padding: 0px; border: 0px; text-size-adjust: none; color: #6f6392; cursor: pointer; -webkit-tap-highlight-color: rgba(0, 0, 0, 0.498039);\"><a class=\"footnoteLink jsHasModalListener jsNoScroll\" href=\"https:\/\/www.jw.org\/en\/news\/legal\/by-region\/germany\/courts-recognize-conventions-as-religious-holidays\/#footnote1\">*<\/a><span style=\"color: #333333;\">\u00c2\u00a0<\/span><span style=\"color: #333333;\">The court ruled in favor of the parents, recognizing that the annual regional conventions of Jehovah\u00e2\u20ac\u2122s Witnesses are religious holidays. The Board appealed, arguing that the conventions of Jehovah\u00e2\u20ac\u2122s Witnesses are not religious holidays because they are festive events, not special days that are considered holy, such as Christmas, Easter, or national holidays.<\/span><\/div>\n<p id=\"p6\" class=\"p6 disableActiveState jsHasHighlightListener\" style=\"text-align: justify; margin: 1.25em 0px; padding: 0px; border: 0px; text-size-adjust: none; -webkit-tap-highlight-color: transparent;\">On July\u00c2\u00a027,\u00c2\u00a02015, the Higher Administrative Court of Hesse upheld the lower court\u00e2\u20ac\u2122s decision. The higher court declared that the definition of a religious holiday depends solely upon the religious association\u00e2\u20ac\u2122s own view. The court saw the clear separation between religious affairs and those of the State, stating: \u00e2\u20ac\u0153Otherwise the State would infringe upon the autonomy guaranteed in the Basic Law [that is, Constitution of Germany] to churches and religious and ideological associations and upon their independence in their own sphere.\u00e2\u20ac\u009d The State is \u00e2\u20ac\u0153obligated to maintain ideological and religious neutrality.\u00e2\u20ac\u009d<\/p>\n<p id=\"p7\" class=\"p7 disableActiveState jsHasHighlightListener\" style=\"text-align: justify; margin: 1.25em 0px; padding: 0px; border: 0px; text-size-adjust: none; -webkit-tap-highlight-color: transparent;\">The higher court also referenced the official website of Jehovah\u00e2\u20ac\u2122s Witnesses, which explains that the Witnesses consider their conventions to be religious holidays. We also highly value religious education because it teaches our children to develop a love for spiritual things and to develop a personal relationship with God, which helps them to be loving, considerate, and well-rounded. We are grateful to the legal authorities for their ruling.\u00e2\u20ac\u009d<\/p>\n<p id=\"p10\" class=\"p10 disableActiveState jsHasHighlightListener\" style=\"text-align: justify; margin: 1.25em 0px; padding: 0px; border: 0px; text-size-adjust: none; -webkit-tap-highlight-color: transparent;\">Armin Pikl, attorney for the Falcones, stated: \u00e2\u20ac\u0153This ruling recognizes that conventions of Jehovah\u00e2\u20ac\u2122s Witnesses are sacred events and reaffirms the right of parents to educate their children according to their religious beliefs. Students who are Jehovah\u00e2\u20ac\u2122s Witnesses will benefit throughout their school years from this exemption from class to attend these wholesome conventions.
